I believe my case to be exactly like the one posted here Link
the batteries in the arms are probably not charging.
I first tried assembling them out of the box seating the TRRS jack fully and firmly and tapping the end of the controller (short and long) as well as closing the tweezers.
I then moved to attempting to update the firmware as the controller seems to be fully functional. displaying DFU:v3.53 4.764V.
the firmware update seemed to take as the controller would disconnect and reconnect after dropping the .hex file and then show a .rdy file
I then moved on to trying the reset method of blanking out cal.ini and replacing the contents with "load defaults".
that reset seemed to work as intended but the tweezers would still not power on afterwards.
just to be safe I have tried charging the arms with one of my computer's usb ports overnight, then overnight with an asus 5v 2a usb-A charger.
during this period until today the light on the arms never turned off so I'm fairly confident the batteries aren't taking a charge.
